Welcome to Modiva Launcher. By accessing or using our website located at https://modiva-launcher.xyz/ ("Site") and our launcher software services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Services.

1. Eligibility

By using our Services, you represent and warrant that you meet the following age requirements:

General Use: You must be at least 13 years of age to download and use the Modiva Launcher.
Server Listing: You must be at least 18 years of age to add a server to our server list or purchase premium features related to server promotion.

2. User Accounts & Termination

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process.

Security: You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password.
Termination: We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Services at our sole discretion, for any reason, including but not limited to a violation of these Terms or abuse of our Services.

3. User-Generated Content (UGC)

Our Services allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content").

Ownership: You retain full ownership of all Content that you post to Modiva Launcher.
License: By posting Content to the Services, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, perform, display, reproduce, and distribute such Content on and through the Services. This license is solely for the purpose of operating, promoting, and improving our Services (e.g., displaying your server in the server list).

4. Subscriptions and Payments

Some parts of the Services (such as Premium Server Listings) are billed on a subscription basis ("SaaS").

Billing: You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of subscription plan you select.
No Free Trials: We do not currently offer free trials for our premium services.

5. Refund Policy

All purchases made through Modiva Launcher are generally non-refundable.

Exceptions: We offer refunds only in the specific instance where a purchased product or service completely fails to function (e.g., you purchased a Premium Server Listing renewal, and the premium status was never activated on your account due to a technical error on our end).
To request a refund under this exception, you must contact us at modivalauncher@gmail.com with proof of purchase and a description of the error.

6. Prohibited Uses

You may use the Services only for lawful purposes. You agree not to use the Services:

In any way that violates any applicable local, national, or international law.
To exploit, harm, or attempt to exploit or harm minors in any way.
To transmit any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
To impersonate or attempt to impersonate Modiva Launcher, a Modiva Launcher employee, another user, or any other person or entity.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
